1. Introduction

1.1. We are Built for Mars Ltd (“Company”, “we”, “us”, “our”), a company registered in the United Kingdom at 10 Beacon Drive, Seaford, East Sussex BN25 2JY, UK. Our VAT number is 355600216.

1.2. These combined Terms & Conditions and Privacy Policy (“Agreement”) govern your use of builtformars.com, its related SaaS platform, blog, AI tools, plugins, and services (the “Service”).

1.3. By creating an account or using the Service, you agree to this Agreement. If you do not agree, you must not use the Service.

2. Eligibility & Accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction).
  • You are responsible for maintaining the confidentiality of your account details.
  • You must not share login credentials or allow others to use your account.
  • We may suspend or terminate accounts at our discretion if we suspect misuse.

3. License & Use

  • We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business purposes.
  • You must not copy, republish, scrape, resell, or redistribute content from the Service.
  • You must not download or store our content outside the Service unless expressly permitted.
  • All intellectual property rights in the Service remain owned by Built for Mars Ltd.

4. Payments & Subscriptions

  • All billing is handled by Stripe.
  • You can cancel your subscription at any time via your account settings.
  • There are no pro-rata refunds. All sales are final.
  • Access to certain features requires payment (e.g., subscriptions, credits, or one-time purchases).
  • We may change pricing with prior notice.

5. User Submissions & Uploads

  • We will not publish your private design uploads without your explicit consent.
  • We may use anonymised or aggregated inputs to improve our models and tools.
  • You must ensure your submissions do not infringe third-party rights.

6. Feedback

If you provide feedback, suggestions, or ideas regarding the Service, you agree that we may use them freely, without obligation, attribution, or compensation. This helps us improve the Service without disputes over ownership of ideas.

7. AI Tools

  • Our AI tool provides automated insights on designs.
  • The tool may be inaccurate, incomplete, or misleading. It is not professional advice.
  • We are not liable for any decisions made based on AI suggestions.
  • You must purchase credits through builtformars.com to use the AI plugin (e.g. Figma).
  • We do not guarantee permanent storage of your uploads or past entries.

8. Feature Changes & Deprecation

We reserve the right to:

  • Remove, modify, or deprecate features or modules.
  • Migrate user data between systems or formats.
  • Sunset or discontinue parts of the Service.
  • Remove, edit or add any content.

9. Excessive Use & Throttling

If you use the Service (including APIs, plugins, or storage) in a way that exceeds reasonable limits or negatively impacts others (e.g., excessive uploads, scraping, automated requests), we reserve the right to:

  • Throttle, restrict, or suspend your usage.
  • Terminate access in cases of abuse.

10. Prohibited Uses

You must not use the Service to:

  • Spam, harass, or abuse other users.
  • Upload or distribute malware, viruses, or malicious code.
  • Reverse engineer, decompile, or attempt to extract source code.
  • Circumvent security measures, account limits, or access restrictions.
  • Interfere with or disrupt the Service’s performance or infrastructure.
  • Engage in illegal or infringing activities.

11. Data Controller Role

Built for Mars Ltd is the Data Controller for all personal data collected through the Service. We decide what data is collected and why. We do not act as a Data Processor for customers’ end-user data.

12. Data We Collect

We may collect:

  • Account details: name, email, login, password (hashed).
  • Payment details: processed securely via Stripe.
  • Uploads: designs, files, or content you submit.
  • Usage data: pages visited, features used, device/browser type, IP address.
  • Cookies & analytics data (see Section 13).

13. Cookies & Tracking

  • We use cookies and similar technologies to make the Service work and to analyse usage.
  • Essential cookies are required for security and basic functionality.
  • Analytics cookies (e.g., Google Analytics, Hotjar) are used to track user behaviour and improve the Service.
  • In the UK/EU, non-essential cookies are only used with your consent (via a cookie banner).
  • You can disable cookies via your browser, but some features may stop working.

14. How We Use Data

21. Termination

  • Upon termination, your rights to use the Service cease immediately.

22. Disclaimers & Limitation of Liability

  • The Service is provided “as is” and “as available”.
  • We disclaim all warranties (express or implied), including fitness for a particular purpose.
  • To the maximum extent permitted by law, our liability is limited to the fees you paid us in the 12 months before the claim.
  • We are not liable for indirect or consequential damages (e.g. lost profits, lost data).

23. Governing Law

This Agreement is governed by the laws of England & Wales. Disputes shall be resolved in the courts of England & Wales unless another jurisdiction is required by law.

24. Changes to This Agreement

We may update this Agreement from time to time. Material changes will be notified via email or on the Service. Your continued use after changes indicates acceptance.
